My partner received zero points on her work capability assessment. I asked for the report. It was absolutely unbelievable and bore no resemblance to the assessment. At at that time we had no experience of ATOS, in my naivety I called and asked the DWP if they had got my partners report mixed up with someone else’s !
There were blatant errors, eg:-
- “Did not bring medication” – when we took a big box of it and the HCP handled it!
- Large errors in the listed medication despite the HCP reading from the packages.
There were outright lies, eg:-
- No evidence of mental health needs given. I attempted to show the HCP an assessment letter from the Mental Health Unit at Northwick Park Hospital and he said it was not necessary.
The most upsetting aspect for my partner was that a lot of the assessment was talking about her faecal incontinence issues. The HCP then stated in several places that she did not suffer from incontinence (but also contradicted himself!)
The constant 3 years of liquid faeces stated to the HCP is hardly ‘every so often’
Much of the assessment was spent talking about the side effects of the intensive medication that my partner takes (I have detailed these in an earlier post). The above shows the result of these conversations!!!
Other parts of the assessment were simply made up:-
This was never even mentioned. My partner has not ‘walk(ed) to the local shops’ in the 2 years we have lived here. This is just made up.
My partner explained that she has had to give up most of her hobbies through her illness. She said that she cannot focus on patterns and now does not knit apart from making simple squares to make blankets for the cats home when she is able as she can no longer focus on patterns. The HCP manipulated this into the above.
Another made up statement. Many of my partner’s appointments involved infusions which last for several hours and are physically draining. Even if she did drive herself for appointments, there is no way she could drive herself back and we would have a line of cars left at the hospital!
Again completely made up! Her ESA50 form was filled in with a lot of help by myself and an advisor. My partner opens no letters whatsoever and all of her affairs are taken care of by myself – statements like these were not discussed at the assessment and simply made up by the HCP.
Again words fail me. Elsewhere in the document, the HCP documents the recent extreme deterioration and admission to hospital in emergency circumstances in the previous month and yet he says ‘it has not changed’ !!!
Again we naively assumed that these assessments were fair. The HCP states several positive aspects of my partners abilities but does not state, for example, that she fell down whilst being weighed and had to be assisted by the HCP.
Utterly bizarre. My partner is treat solely by specialists. We moved to this area purely so that she could be treat at a specialist colo-rectal hospital. She is treat by a wonderful specialist team and she is under one of the leading consultants in his field in the country.
Another totally made up statement. This was not discussed at all. If it had been or if the HCP had read the pyschotherapist report offered to him, then he would have know this statement to be false.
On several occasions, questions had to be repeated by myself or the HCP as my partner lost her track of the question asked.
Many of these statements are repeated throughout the document.
Needless to say, sight of this report was extremely upsetting and stressful for my partner.
